Freeride skiing is the fastest-growing sector of the skiing industry, but there are no studies analyzing its nature and values. First, we provide descriptions of freeride skiing and competitive freeride skiing, trying to analyzing the nature of these activities in comparison and contrast with conceptions of traditional sport and nature sport. Whilst freeride skiing must be seen in some sense as a nature sport, competitive freeride skiing is best seen within the category of traditional sport. However, these ‘new’ sports raise (...) questions about the adequacy of our current categories, leading us to our second task, which was to identify and discuss the values of freeride skiing. We identify freedom and creativity as primary values, which lead to a greater rapport with nature, and a greater attention to risk, danger and safety, as concomitant values. Finally, we briefly indicate further values of the activity, such as responsibility, community and preservation of the practice. (shrink)

Paediatric genomic research raises particularly challenging questions on whether and under what circumstances to return research results. In the paediatric context, decision-making is guided by the best interests of the child framework, as enshrined in the 1989 international Convention on the Rights of the Child. According to this Convention, rights and responsibilities are shared between children, parents, researchers, and the state. These "relational" obligations are further complicated in the context of genetic research.

So the Uruguayan footballer Luis Suárez has confessed, apologised and given assurances as to future good behaviour, after his 2014 World Cup assault on the Italian defender Chiellini. There were three immediate excuses and mitigations offered, which we dismiss: that it was inconsequential; that it was no different from many other ‘assaults’; and that it was not particularly serious. Our central question has a different focus: what makes biting in sport such a bad thing, especially since it does not seem (...) always to threaten as much harm to opponents as some other practices? We examine the place of biting in sports rules, especially in combat and contact sports, and the role of consent and criminal liability, before considering when and why biting is seen as unacceptable. We consider arguments from harm, skin penetration, ‘dirty fighting’ and animalism. Finally, we consider the topical case of Luis Suárez, distinguishing reactive from proactive bitin.. (shrink)

Many think that it would be wrong to defend an individual from attack if he competently and explicitly refuses defensive intervention. In this paper, I consider the extent to which the preferences of victims affect the permissibility of defending groups or aggregates. These cases are interesting and difficult because there is no straightforward sense in which a group can univocally consent to or refuse defensive intervention in the same way that an individual can. Among those who have considered this question, (...) the dominant view is that that consent imposes only an extremely weak constraint on defending groups. I argue that this is mistaken and defend a much more robust requirement. Indeed, on the account that I develop there are cases in which the refusal of a single member of a victim is enough to make it impermissible to defend a much larger group. At the heart of my account is the idea that consent functions as an internal component of the broader requirement that defensive harms be proportionate: if a victim validly refuses defensive intervention, the fact that defence will benefit him cannot be used to justify harming innocents as the lesser-evil. An important implication of this view is that what constitutes sufficient consent from the members of a victim group will vary on a case-by-case basis. (shrink)

This paper side-steps the question of whether ‘the’ concept of sport exists, or can be usefully analysed. Instead, I try to explain the much more modest aim of exhibition-analysis, which is to seek a description of an actually existing example of some concept of sport internal to a normative position. My example is that of Olympic-sport. I try to set out its logically necessary conditions, which of course are conditioned by its context within a theory that emphasises the values of (...) formal competition, citius-altius-fortius, and excellence in contest, as well as rule-based procedural values related to fairness, justice and equality. In so doing, I readily accept that other kinds of sport can be similarly analysed, and I do not press the value claims of Olympic-sport. Instead, I try to show how Olympic-sport, properly construed, can accommodate the concerns of my critics with regard to sport’s play and game-like characteristics. (shrink)

Since its earliest incarnations, just war theory has included the requirement that war must be initiated and waged by a legitimate authority. However, while recent years have witnessed a remarkable resurgence in interest in just war theory, the authority criterion is largely absent from contemporary discussions. In this paper I aim to show that this is an oversight worth rectifying, by arguing that the authority criterion plays a much more important role within just war theorising than is commonly supposed. As (...) standardly understood, the authority criterion provides a necessary condition for the justification of the resort to war, but has no bearing on the question of permissible conduct in war. In opposition, I argue for an alternative interpretation of the criterion, which attributes to it a fundamental role in assessing this latter question. With this revised interpretation in place, I then demonstrate its advantages by applying it to the practical issue of armed conflicts that are initiated and fought by non-traditional belligerents. While several theorists have recognised that this common feature of modern armed conflict poses a challenge to mainstream just war theory in general—and to the authority criterion in particular—I argue that existing discussions frequently misconstrue the nature of the challenge, since they assume the standard interpretation of the authority requirement and its role within the theory. I then show that the revised interpretation provides a clearer account of both the challenge posed by non-traditional belligerency and the kind of response that it requires. (shrink)

This paper explores the connections between two central topics in moral and political philosophy: the moral legitimacy of authority and the ethics of causing harm. Each of these has been extensively discussed in isolation, but relatively little work has considered the implications of certain views about authority for theories of permissible harming, and vice versa. As I aim to show, reflection on the relationship between these two topics reveals that certain common views about, respectively, the justification of harm and the (...) moral limits of authority require revision. The paper proceeds as follows. Sections 1 and 2 clarify the question to be addressed and set out two main claims that I will defend. Sections 3-5 argue for the first claim. Despite the fact that six years have passed since 9/11, the Pentagon's recent decision to try six Guantanamo detainees for capital crimes such as terrorism and support of terrorism made national headlines. William Glaberson, "U.S. Charges 6 With Key Roles in 9/11 Attacks", N.Y. Times, Feb. 11, 2008, at A1. In this Debate, Professors Amos N. Guiora, of the University of Utah, and John T. Parry, of Lewis & Clark Law School, attempt to settle the question of what sort (...) of forum is most appropriate to try the thousands of individuals in U.S. custody who are suspected of terrorism. Professor Guiora considers three forum options: treaty-based international terror courts, traditional Article III courts, and a hybrid option he calls domestic terror courts. Ultimately, Professor Guiora argues in favor of domestic terror courts, which he describes as being able to balance the legitimate rights of the individual with the equally legitimate national security rights of the state. He considers this option to be the most practical and expedient policy solution, necessitated by an untenable tension between the understanding that some of the detainees present a genuine threat to American national security, and an awareness that indefinite detention violates constitutional principles and fundamental concepts of morality. Professor Parry agrees that current U.S. policy toward detainees has been misguided, but does not believe that innovations of the sort proposed by Professor Guiora are necessary. Rather, he suggests that policymakers should choose Article III courts rather than hybrid courts for trials of suspected terrorists, with military courts as a fallback option. Professor Parry points to research that shows that the federal government is often able to prosecute suspected terrorists in federal court, and therefore considers alternative proposals to Article III courts to be solution[s] in search of a problem. Professor Parry realizes that trial in federal court will not be possible for every suspected terrorist, and concludes that, [f]or people who pose a risk but whose conduct may not violate federal criminal law, prolonged preventive detention is the best choice. Despite a recent explosion of interest in the ethics of armed conflict, the traditional just war criterion that war be waged by a “legitimate authority” has received less attention than other components of the theory. Moreover, of those theorists who have addressed the criterion, many are deeply skeptical about its moral significance. This article aims to add some clarity and precision to the authority criterion and to debates surrounding it, and to suggest that this skepticism may be too quick. First, (...) it provides an analysis of the authority criterion, and argues there are (at least) two distinct moral claims associated with the criterion, requiring separate evaluation. Second, it outlines an increasingly influential “reductivist” approach to just war theory, and explains how it grounds powerful objections to the authority criterion. Third, and in response, it sketches the most promising strategies for providing a (qualified) defense of authority, and the further questions and complications they raise. Importantly, these strategies aim to rehabilitate the authority criterion from within a broadly reductivist view. (shrink)

This paper presents some of the background to the development of the Youth Olympic Games, the principles underlying them, and some of the practical challenges in implementing them. Regarding the sports programme, modifications from the Olympic Games programme are noted, and innovations examined in terms of underlying values, such as immaturity and harm, talent identification and early specialisation, and the exploitation of young athletes. Issues arising from the first edition of the YOG include participation and equality of opportunity, selection of (...) sports and nations for the programme, age and fairness, age falsification and cheating, victory and defeat, participation and excellence, and political discrimination, peace and international understanding. The paper concludes that, although many of the above issues present already-existing challenges for the Olympic movement, albeit in a novel form, there were also some novel issues thrown up by a ?youth? edition of the Olympic Games, and many of the ethical and other value questions raised have much wider applications and consequences. It is to be hoped that ethical issues arising out of the YOG will provide a fresh impetus towards discussions as to the nature and promotion of ethical sport. (shrink)

In this article, I argue that, in showing inconsistency of beliefs, Socratic elenchus is showing incompatibility of the desires those beliefs express. This thesis explains Socrates’ claim that, in refuting Callicles, he is also restraining his desires. The beliefs in question are about the best kind of life to lead; such beliefs express the second order desire to lead a life in which certain sorts of first order desires are satisfied. Socrates’ elenchus shows that Callicles is caught between two incompatible (...) second order desires: a desire to lead of life of enormous pleasure and a desire to lead a life in which his love of honor is satisfied. Socrates does not succeed with Callicles because the way out of this dilemma depends on a type of desire not found in the moral psychology of the Gorgias, i.e., a desire whose satisfaction is pleasure unmixed with pain, described in Republic 583c-585e and Philebus 50e-52b. Drawing on insights from conversation analysis, discursive psychology and social psychology, this article describes some interactional features of two celebrity TV confessionals and the resources used by the TV interviewers and celebrity guests to attribute, accept or deny responsibility for their transgressions. The analytic interest lies in how confessions are locally and interactionally managed, that is, how ‘doing confessing’ is achieved in the television interview context. We show how the host’s opening turn constrains the celebrity guest’s contribution and secures overt (...) admission of guilt, while simultaneously inviting the celebrity guest to tell their side of the story. We also show how celebrity guests produce descriptions which minimize the extent and severity of their transgressions, reduce agency and transform the character of their transgression. In doing so, we argue that celebrity interviewees can convey mitigations and extenuations which diminish the extent of their responsibility – calling into question the very nature of their confession. We propose that our findings demonstrate the hybrid nature of interviewing in the celebrity TV confessional and contribute to our understanding of how ‘doing confessing’ in the public eye is discursively and interactionally negotiated. The topic of "evil" means different things depending upon context. For some, it is an archaic term, while others view it as a central problem of ethics, psychology, or politics. Coupled with state power, the problem of evil takes on a special salience for most observers. When governments do evil -in whatever way we define the term - the scale of harm increases, sometimes exponentially. The evils of state violence, then, demand our attention and concern. Yet the linkage of evil (...) with state power does not resolve the underlying question of how to understand the concepts that we invoke when we use the term. Instead, the question becomes what evil means in the context of and in relation to state power. The fifteen essays in this book bring multiple perspectives to bear on the problems of state-sponsored evil and violence, and on the ways in which law enables or responds to them. The approaches and conclusions articulated by the various contributors sometimes complement and sometimes stand in tension with each other, but as a whole they contribute to our ongoing effort to understand the characteristics and workings of state power, and our need to grapple with the harm it causes. This article explores a number of questions about the relationship between intimacy and research that were bought into sharp focus for me by a disturbing event: my unexpected encounter with Iris Murdoch's archived brain. In considering how very intimate experiences such as these are both constructed and narrated to wider audiences, I begin by exploring the nature of intimacy itself. Here I argue that intimacy is the product of not only social but spatial relations, relations that may, in contrast (...) to popular conceptions, be `stretched out' to create what I call here `distributed spaces of intimacy'. In exploring the role that material artefacts can play as objects that create essential points of interface between individuals and communities that are geographically and socially distant, I also draw attention to the necessarily partial and relational nature of intimacy. In the final section of the article I turn to consider the impact that intensely personal experiences may have on research methodologies and the vexatious question of how, if at all, it is possible to speak of, or report them, without transgressing important social, moral and ethical conventions. While providing a welcome and timely revision of the now outdated Human Tissue Act of 1961, the newly introduced Human Tissue Bill of 2004 contains a number of anomalies in its drafting that threaten to undermine its effectiveness in practice. Two examples: the first relating to the status of 'remnant or waste' tissue and the second relating to the status and use of artefacts created from collected tissue are here employed to illustrate some of the definitional and categorical inconsistencies that (...) are evident in the Bill. Having identified these, the paper then provides an analysis of how these inconsistencies may act to severely constrain the ways in which retained tissue may be lawfully employed in biomedical research and to confuse questions of who may, or may not, have formally recognised interests in types of processed human tissue. Paper, $24.95.This volume aims to provide an explication of the natural law theory of St. Thomas Aquinas “consistent with the expectation of philosophers in the analytic tradition” (10–11, 17). Accordingly, the author begins, in the first (...) three chapters, by reviewing the recent history of Anglo-American metaethics, aligning himself broadly with those critics of analytic ethics like G. E. M. Anscombe, Alasdair MacIntyre, John Finnis, Martha Nussbaum, and Henry Veatch, who have argued for a recovery of Aristotelian moral theory, against varieties of intuitionism, non-cognitivism, and neo-Kantianism. Lisska’s principal objective is to present a reconstructed natural law theory based primarily on Aquinas’s discussion in questions 90–97 of the prima secundae of the Summa theologiae (a translation of these questions is appended to the book). This he offers mostly in the fourth, fifth and eighth chapters of the book. The sixth chapter is a critique of John Finnis’s account of natural law and the seventh is an exposition of the views of Henry [End Page 526] Veatch. The ninth chapter presents some suggestions on how the author’s account can illuminate controversies over the grounding of human rights, and the tenth is a brief conclusion.The three introductory chapters consist mainly of a review and endorsement of the critics of academic ethics since Moore’s Prıncipia Ethıca. Having accepted arguments for the inadequacy of modern ethics, Lisska argues for the recovery of Aquinas’s views which he sees as in fundamental continuity with Aristotelian ethics (84, 89, 100, 102–105, 108, 134–36). His central thesis is that natural law is a “second-order inquiry” based on a realist metaphysics of the human person as defined by a set of dispositional properties, the realization of which constitutes Aristotelian eudaimonia and Thomistic beatitudo (17, 104–106, 131–37, 152–55, 186, 195–201). Moreover, Lisska contends that Aristotelian “eudaimonism” constitutes an adequate account of moral obligation: what he calls, after Veatch, “obligatory teleology” (107–109, 121, 202–205, 235).At the core of Lisska’s account, then, is a metaphysical dispute that pits Aristotelian essentialism against modern reductionist ontology. This metaphysical core is separated from any theological implications in the fifth chapter (especially 119–23, 137) and Lisska reinforces his metaphysical thesis by appealing to Saul Kripke’s discussion of natural kinds and the early work of Hilary Putnam (97–99, 125, 206–209). Given the centrality of metaphysical argument, a critique of Finnis’s theory goes without saying, and Lisska devotes a chapter to it, adding another to expound Henry Veatch’s contrary view.While this book undertakes an important effort to recover a workable natural law theory—especially in its commendable stress on metaphysical questions—it is, as a whole, less satisfactory than it might have been. A good part of this owes to the book’s abstraction from historical questions. No sustained attention is devoted to the problems that accompanied the reception of Aristotle by Christian theologians, nor to the place of natural law in Aquinas’s overall understanding of morality. The former point is not so surprising, given the book’s analytic concerns; the latter, however, carries more serious theoretical implications. Why is it, for example, that natural law takes up so little space compared to the questions on happiness, human acts, and the habits and virtues in the prima secundae, not to mention the detailed treatments of the virtues and vices in the secunda secundae? Similarly, where Aquinas stresses that natural law as law is directed to the common good (Iallae 90.2), Lisska treats it mostly as a guide to “self-realization.”This issue suggests the tensions between Aristotle and Aquinas, tensions that seem to show themselves precisely in Aquinas’s discussion of the very notion of natural law, a notion that has no equivalent in Aristotle. This new English translation of St. Thomas Aquinas's Treatise on Law, found in Questions 90-108 of the First Part of the Second Part of the Summa Theologiae, is the only free-standing English translation of the entire Treatise, which includes both a general account of law (Questions 90-92) and also specific treatments of what St. Thomas identifies as the five kinds of law: the eternal law (Question 93), the natural law (Question 94), human law (Questions 95-97), the Old (...) Law (Questions 98-105), and the New Law (Questions 106-108). According to St. Thomas, law, far from supplanting virtue as a basic principle of action, serves as an independent principle of action that complements virtue and is itself capable of being factored into practical deliberation. The reason is that all of God's precepts, prohibitions, and punishments are aimed at promoting the good of the whole universe and, more particularly, the good for human beings, both individually and within the various forms of social life. Because of this, law serves as both a restraint on bad actions and a spur to good action, i.e., a restraint on actions that take us away from virtue and genuine human flourishing and a spur to actions that promote virtue and flourishing. There are many benefits of having the whole treatise rather than just the first few questions, as has been the standard practice in previous editions of the Treatise on Law. To mention just a few of these benefits, the question on the moral precepts of the Old Law (question 100) helps to illuminate in many different ways the earlier questions on natural law and human law (questions 94-97). Again, the questions on the ceremonial and judicial precepts of the Old Law (questions 101-105) demon-strate in depth the symbiotic relationship that St. Thomas takes to obtain between the Old Testament and the New Testament. The questions on the New Law provide an introduction to the Christian way of life that will be described in incomparable detail in the Second Part of the Second Part, the bulk of which is structured around the treatment of the three theological virtues and the four cardinal virtues. The generality problem is commonly seen as one of the most pressing issues for process reliabilism. The generality problem starts with the following question: of all the process types exemplified by a given process token, which type is the relevant one for measuring reliability? Defenders of the generality problem claim that process reliabilists have a burden to produce an informative account of process type relevance. As they argue, without such a successful account, the reasonability of process reliabilism is significantly undermined. (...) One way for the reliabilist to respond is to attempt to construct such a theory of type relevance. But another way of responding is to argue that, if finding an account of type relevance is a burden for the reliabilist, then it is also a burden for everyone else. Thus, the generality problem doesn’t present some unique reason to reject process reliabilism. I call this latter strategy a parrying response. In this essay, I examine the contemporary parrying responses of Michael Bishop and Juan Comesaña, which have both faced recent criticism. I respond to these critics, and argue that parrying responses are far stronger than defenders of the generality problem have appreciated. (shrink)

One of the most pressing points in the philosophy of sport is the question of a definition of sport. Approaches towards sport vary based on a paradigm and position of a particular author. This article attempts to analyse and critically evaluates a recent definition of sport presented by Jim Parry in the context of argument that e-sports are not sports. Despite some innovations, his conclusions are in many ways traditional and build on the previous positions. His research, rooted in (...) the conceptual analysis, starts with a stipulation that sport is paradigmatically Olympic sport. He defines it then as an ‘institutionalised, rule-governed contest of human physical skill’ i.e., identifies six necessary elements of sport: human (not animals), physical (not chess), skill (not jogging), contest (not mountaineering), rule-governed (not ‘field sports’), institutionalized (not hula-hooping). Our claim is that this definition, despite its methodological clarity, is not accurate and does not sufficiently represent sport outside the Olympic context. First, to say for something to be a sport it is necessary to be a contest leads to a narrow concept of sport. Secondly, Parry’s account lacks the emphasis on game and play-like structures that are inherently present in sport (even in the Olympic sport), namely non-necessity, non-ordinariness, arbitrariness and gratuitousness. We try to direct the attention precisely on these structures and offer an alternative account of sport understood as a modern ‘hard core’ sport that nevertheless reaches important congruences with Parry’s definition. The originality of this contribution lies in presenting the essential qualities of modern ‘hard core’ sports, which, although sometimes hidden in the modern emphasis on high level performances, competition, and results, play an important role in the question how sport ought to be played and approached. The twelve essays collected in the book cover topics such as the relationship between theory and practice, the impact of “ideal justice” and its requirements on individuals’ expectations, the difficulties connected to the selection of second-best options and the role of presumption rules. In addition, Räikkä focuses on conspiracy theories, on the right to privacy, on the possibility of concealing information (...) in social relations, as well as on the moral dilemmas connected to “alien beliefs”, namely beliefs beyond individuals’ self-awareness and conflicting with their considered judgments. He also discusses the fairness of demanding forgiveness and clarifies the notion of self-deception, by investigating its connection with adaptive preferences and religious beliefs. Students of later medieval semantics are familiar with the controversy that developed at the end of the thirteenth century over the signification of names. The debate focused on the signification of common nouns such as ‘man’ and ‘animal’: Do they signify an extramental thing or a mental representation of an extramental thing?Some authors at the end of the thirteenth century also discussed another question concerning what names signify, that is, whether they signify the composite of matter and form or only (...) the form of the composite. The “hard problem” of consciousness is a challenge for explanations of the nature of our phenomenal experiences. Chalmers has claimed that physicalist solutions to the challenge are ill-suited due, in part, to the zombie argument against physicalism. Perry has suggested that the zombie argument begs the question against the physicalist, and presents no relevant threat to the view. Although seldom discussed in the literature, I show there is defensive merit to Perry’s “parry” of the zombie attack. The success of (...) the maneuver suggests a slight softening of the hard problem of consciousness for physicalists. (shrink)
